By accessing or using our website, purchasing a membership, attending classes, or otherwise engaging with our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services. Acceptance of Terms

By accessing and using this website, you accept and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. These Terms apply to all visitors, users, members, and others who access or use the services offered by Primed Combat.

Your continued use of the Primed Combat website or services constitutes your ongoing acceptance of these Terms. If you do not agree to any part of these Terms, you must immediately discontinue use of the site and services.

Use of the Website

You agree to use the Primed Combat website only for lawful purposes and in a manner that does not infringe upon the rights of others or restrict or inhibit anyone else's use and enjoyment of the site. Prohibited behavior includes but is not limited to:

  • Transmitting any unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable content
  • Impersonating any person or entity or misrepresenting your affiliation with any person or entity
  • Uploading or transmitting viruses or any other malicious code that may affect the operation of the website
  • Attempting to gain unauthorized access to any portion of the website or its related systems
  • Using the website for any commercial solicitation without prior written consent from Primed Combat
  • Collecting or harvesting personal information of other users without their consent

We reserve the right to terminate your access to the website at any time, without notice, for any conduct that we, in our sole discretion, believe is in violation of these Terms or is harmful to other users, us, or third parties.

Memberships & Services

Primed Combat offers memberships, classes, and other fitness-related services at our facility located at 924 Elmwood Rd, Lansing, MI 48917. By purchasing a membership or enrolling in any program, you agree to the specific terms associated with that membership or program as communicated at the time of purchase.

Membership benefits, class schedules, instructors, and facility hours are subject to change at any time. We will make reasonable efforts to notify members of significant changes in advance. Primed Combat reserves the right to modify, suspend, or discontinue any service or program at any time without liability.

Memberships are personal and non-transferable. You may not share, sell, or otherwise transfer your membership or access credentials to any other person.

Payments & Billing

All fees for memberships, classes, products, and services are due at the time of purchase unless otherwise specified. By providing your payment information, you authorize Primed Combat to charge the applicable fees to your payment method.

For recurring memberships, you authorize Primed Combat to automatically charge your payment method on the agreed billing cycle until your membership is cancelled in accordance with our Cancellation Policy below.

All prices are stated in U.S. dollars. Primed Combat reserves the right to change pricing at any time. Members on recurring billing plans will be notified of price changes at least 30 days in advance.

Primed Combat uses industry-standard Secure Sockets Layer (SSL) encryption to protect your credit card and payment information during all online transactions. However, we cannot absolutely guarantee the security of information transmitted over the internet; you provide payment information at your own risk.

Cancellation Policy

You may cancel your membership by contacting us directly via email at gray@primedcombat.com or by phone at (517) 332-1049. Cancellation requests must be submitted at least 30 days prior to your next billing date to avoid being charged for the following billing period.

Primed Combat does not offer refunds for partially used membership periods, unused class credits, or products that have been opened or used, except where required by applicable law.

If you believe a charge was made in error, please contact us within 30 days of the charge at gray@primedcombat.com and we will review your account.

Member Conduct

All members and guests are expected to conduct themselves in a respectful, safe, and sportsmanlike manner at all times while at Primed Combat. This includes but is not limited to:

  • Treating all staff, instructors, members, and guests with courtesy and respect
  • Following all facility rules, instructor directions, and posted guidelines
  • Using equipment and facilities safely and returning them to their proper place after use
  • Refraining from aggressive, threatening, or abusive behavior toward any individual
  • Refraining from the use of alcohol, illegal substances, or performance-enhancing drugs while on the premises
  • Wearing appropriate workout attire and maintaining personal hygiene standards

Primed Combat reserves the right to suspend or terminate the membership of any member who violates these conduct standards, without refund, at our sole discretion.

Limitation of Liability

To the maximum extent permitted by applicable law, Primed Combat, its owners, officers, employees, agents, instructors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses resulting from your use of or inability to use our services or website.

In no event shall Primed Combat's total liability to you for all claims arising out of or relating to these Terms or your use of our services exceed the total amount you paid to Primed Combat in the twelve (12) months preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such cases, the above limitations may not fully apply to you.

Assumption of Risk & Waiver

Participation in martial arts, combat sports, fitness training, and related physical activities involves inherent risks of injury, including but not limited to sprains, strains, fractures, contusions, and in rare cases more serious injury. By participating in any class, training session, or activity at Primed Combat, you voluntarily assume all such risks.

You acknowledge that you are physically capable of participating in the activities you choose, that you have consulted with a qualified medical professional if necessary, and that you are participating at your own risk. Primed Combat strongly recommends that all members consult with a physician before beginning any new fitness or martial arts program.

By using our facility or participating in our programs, you agree to release, waive, discharge, and covenant not to sue Primed Combat or its instructors, employees, and agents from any and all liability, claims, demands, or causes of action arising from your participation in any activity at our facility.

Additional waivers or liability releases may be required at the time of membership signup or prior to participation in certain programs or events.

Intellectual Property

The Primed Combat website and all of its content, including but not limited to text, graphics, logos, images, photographs, audio clips, and software, are the property of Primed Combat or its content suppliers and are protected by applicable United States and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content from this website without the prior written permission of Primed Combat. Unauthorized use of any content may violate copyright, trademark, and other applicable laws.

The Primed Combat name, logo, and related marks are trademarks of Primed Combat. Nothing in these Terms grants you any right to use any trademark, service mark, or logo belonging to Primed Combat.

Privacy

Your use of the Primed Combat website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, and protect your personal information.

SMS & Text Message Communications

By providing your phone number and opting in to receive text messages from Primed Combat, you consent to receive SMS communications including but not limited to membership updates, class reminders, promotional offers, and facility announcements.

Primed Combat will not share, sell, or disclose your mobile opt-in data or phone number to third parties without your explicit consent, except where required by law. Text messaging originator opt-in data and consent will not be shared with third parties.

To opt out of text messages at any time, reply "STOP" to any message you receive from us. You will be immediately removed from future SMS communications. For help, reply "HELP" or contact us at gray@primedcombat.com.

Message and data rates may apply. Message frequency varies. Please note that as of February 1st, 2025, full blocking of unregistered outgoing messages has begun. It can take 2 weeks or more for The Campaign Registry to vet a registration after submission.

Carrier Liability Disclaimer: Primed Combat is not responsible for any delays or failures in the receipt of any SMS messages connected with our program. Delivery of SMS messages is subject to effective transmission from your network operator. Message delivery is not guaranteed by Primed Combat. Wireless carriers, including but not limited to AT&T, Verizon, T-Mobile, and others, are not liable for delayed or undelivered messages.

Age Restriction (18+)

The services, memberships, and SMS communications offered by Primed Combat are intended for individuals who are 18 years of age or older. By using our website, purchasing a membership, or opting in to receive SMS communications from Primed Combat, you confirm that you are at least 18 years of age.

Minors under the age of 18 are not permitted to independently purchase memberships, enroll in programs, or opt in to SMS communications without the express written consent of a parent or legal guardian. Parents or guardians who enroll minors in Primed Combat programs accept these Terms on behalf of the minor and assume full responsibility for the minor's participation and compliance.

Primed Combat reserves the right to terminate membership or revoke access to services for any individual who misrepresents their age. If you are a parent or guardian and believe your minor child has enrolled without your consent, please contact us immediately at gray@primedcombat.com or (517) 332-1049.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or your use of Primed Combat's services shall be subject to the exclusive jurisdiction of the state and federal courts located in Ingham County, Michigan.

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
